Welcome to BulkMailer (bulkmailer.dev)! These Terms and Conditions govern your access to and use of our SaaS bulk email sending platform. By accessing or using our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to all of these Terms and Conditions, do not use our services.
1. Account Eligibility
- To create an account and use BulkMailer, you must be at least eighteen (18) years of age. By creating an account, you represent and warrant that you are 18 years of age or older.
- BulkMailer reserves the right to refuse service to anyone for any reason at any time.
2. Acceptable Use Policy
You agree not to use BulkMailer for any unlawful, abusive, or unethical purposes. Specifically, you agree to the following:
- No Spam: You expressly agree not to send any unsolicited commercial email (spam) through our platform. This includes, but is not limited to, sending emails to recipients who have not explicitly opted-in to receive communications from you.
- No Illegal Content: You shall not use BulkMailer to send any content that is illegal, defamatory, libelous, threatening, harassing, abusive, hateful, or racially or ethnically objectionable. This includes content relating to child exploitation, terrorism, or any other illegal activity.
- Compliance with Laws: You are solely responsible for ensuring that your use of BulkMailer complies with all applicable laws and regulations, including, but not limited to, the CAN-SPAM Act in the United States, the General Data Protection Regulation (GDPR) in the European Union, and any other relevant email marketing and data privacy laws in your jurisdiction and the jurisdictions of your recipients.
- Recipient Consent: You represent and warrant that you have obtained all necessary consents from your email recipients to send them the messages you transmit through BulkMailer. You are solely responsible for managing and proving recipient consent.
- User as Sole Sender: You acknowledge and agree that you are the sole sender of all emails transmitted through your account on BulkMailer. BulkMailer acts solely as a technical service provider and has no control over the content of your emails or the recipients to whom they are sent.
- Prohibited Content: You are prohibited from sending emails related to:
- Illegal products or services.
- Fraudulent schemes.
- Misleading offers.
- Nutraceuticals, pharmaceuticals, and dietary supplements requiring FDA approval (if not approved or marketed illegally).
- Adult content (pornography, escort services, sexually explicit material).
- Gambling or betting services (if not legally sanctioned or if targeting minors).
- "Get rich quick" schemes or pyramid schemes.
- Multi-level marketing (MLM) schemes that primarily focus on recruitment rather than product sales.
- Controversial political content that incites hatred or violence.
- Hate speech or discrimination against any group.
- Malware, viruses, or any harmful code.
3. User Provided SMTP Servers
BulkMailer is a platform that allows you to manage and send bulk emails. You understand and agree that:
- BulkMailer does not provide its own email sending infrastructure (SMTP servers).
- You are solely responsible for providing and configuring your own SMTP servers (Simple Mail Transfer Protocol) to send emails through BulkMailer.
- You are responsible for the compliance, deliverability, and reputation of your chosen SMTP servers.
- You must ensure that your SMTP servers are properly authenticated (e.g., SPF, DKIM, DMARC) to improve deliverability and prevent abuse.
- BulkMailer is not responsible for any issues arising from the performance, configuration, or reputation of your third-party SMTP servers.
4. AI-Generated Content Responsibility
If you choose to use Artificial Intelligence (AI) tools (whether provided by BulkMailer in the future or third-party tools) to generate content for your emails, you acknowledge and agree that:
- You are solely responsible for reviewing, verifying, and ensuring the accuracy, legality, and appropriateness of any AI-generated content before sending it.
- BulkMailer makes no representations or warranties regarding the accuracy, originality, or legality of AI-generated content.
- You assume all risks associated with using AI-generated content, including potential copyright infringement, factual errors, or misleading information.
5. USDT Crypto Subscriptions
- BulkMailer offers subscriptions primarily through USDT (Tether) cryptocurrency payments.
- Subscription tiers and pricing are denominated in USDT, currently ranging from 9.99 to 99.99 USDT per month (the top Enterprise tier is discounted 60%, so 39.99 USDT). Specific pricing details are available on our pricing section.
- No Refunds After Credits Used: Due to the nature of cryptocurrency transactions and the immediate provisioning of service credits, all USDT subscription payments are non-refundable once any portion of the associated email sending credits or functionalities have been utilized.
- No Chargebacks: As cryptocurrency transactions are irreversible by design, you expressly agree that there will be no chargebacks, reversals, or disputes initiated for USDT payments made to BulkMailer. By making a payment, you acknowledge and accept this policy.
- Unique-Amount Payment Matching: To streamline payment processing and account activation, BulkMailer may require you to send a unique, slightly varied USDT amount. For example, instead of sending exactly 100 USDT, you might be asked to send 100.1234 USDT. This unique amount helps us automatically match your payment to your specific account. Failure to send the exact unique amount requested may delay account activation or credit allocation.
- Admin Manual Approval Possible: Notwithstanding automatic payment processing, BulkMailer reserves the right to manually review and approve any subscription or payment. In certain circumstances, an administrator may need to verify a payment or account, which could result in a temporary delay in service activation.
6. Suspension for Abuse
BulkMailer reserves the right to suspend or terminate your account immediately, without prior notice, if we determine, in our sole discretion, that you have violated these Terms and Conditions, including but not limited to, engaging in spamming, sending illegal content, or violating any applicable laws. In the event of suspension or termination due to abuse, any unused subscription credits or payments will be forfeited, and no refunds will be issued.
7. DMCA Policy (Digital Millennium Copyright Act)
- BulkMailer respects the intellectual property rights of others. If you believe that content available on or through BulkMailer infringes upon your copyright, please send a DMCA notice to support@bulkmailer.dev.
- Your notice must include: (a) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) Identification of the copyrighted work claimed to have been infringed; (c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (d) Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an e-mail address; (e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- We will respond to valid DMCA notices in accordance with applicable law.
8. Disclaimers
BULKMAILER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BULKMAILER DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BULKMAILER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE BULKMAILER AT YOUR OWN SOLE RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BULKMAILER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, BULKMAILER. THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF BULKMAILER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF BULKMAILER TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO BULKMAILER DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless BulkMailer, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your violation of these Terms and Conditions or your use of BulkMailer, including, but not limited to, your violation of any applicable laws, regulations, or third-party rights (such as copyright or privacy rights).
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of [Jurisdiction of Company Registration], without regard to its conflict of law principles.
